Image Usage Consent

Important: By uploading images and checking the boxes below you are giving Muruga Ltd the permissions described in this form. If you are providing images of a child under 13, parental authorisation is required (see Section F). Photographs are personal data under UK GDPR – see our Privacy Policy for full details.

A. Parties

Data Controller / Licensee: Muruga Ltd (Custom Comic Shop), contact@customcomic.shop.
Uploader / Licensor: the person uploading the images (the “You / Uploader / Model”).

B. Purpose of this Release

You authorise Muruga Ltd to process and use the images and story materials you upload only for the purposes of (a) producing, printing and delivering the bespoke comic(s) you have ordered, (b) necessary communications with printers / couriers / contractors for fulfilment, and (c) limited internal quality control and dispute resolution. Any marketing/portfolio use requires a separate explicit opt-in (Section D). This processing is carried out in accordance with our Privacy Policy and Data Retention Schedule (images retained for operational purposes for 14 days after final delivery unless you opt-in to longer retention).

C. Licence granted by uploader (production & fulfilment)

By agreeing to this Release you grant to Muruga Ltd a non-exclusive, worldwide, royalty-free licence to:

Use, copy, reproduce, edit, adapt, transform and process the uploaded images and story text solely to produce the ordered comic and to arrange fulfilment (including transmission to printers and couriers).
Retain a secure copy of the images and related production materials for operational quality control and dispute handling for 14 days after final delivery (longer only with your explicit opt-in).
Use minimal metadata (uploader name, order number) as necessary for order processing and dispute resolution.

This licence does not transfer ownership of the original images to Muruga Ltd. You may continue to use your images as you wish, subject to any third-party rights.

D. Optional Marketing / Portfolio Licence (explicit opt-in)

If you opt-in by ticking the marketing box, you grant Muruga Ltd a separate non-exclusive, worldwide, royalty-free licence to use the finished comic images or selected uploaded images for Muruga Ltd’s marketing, portfolio, social media, promotional materials and website until you withdraw consent. You can withdraw marketing consent at any time (withdrawal will not affect processing necessary to fulfil existing orders). Withdrawal instructions: contact@customcomic.shop.

E. Warranties & indemnity (important)

By uploading images you warrant and represent that:

You are the copyright owner of the images, or you have obtained all necessary rights, permissions and consents (including from any photographer or third-party rights holder) to permit the uses set out in this form; and
You have obtained the consent of every person recognisable in the image (or the parent/guardian where required); and
The images do not contain illegal content, defamation, pornographic or explicit sexual content, hate speech, or material that infringes third-party rights.

You agree to indemnify and keep Muruga Ltd indemnified against any losses, damages, liabilities, costs or expenses arising from any breach of these warranties (including third-party claims for copyright or misuse of likeness).

Note: If you are not the copyright owner (for example a photographer), you must either obtain a written licence from the copyright owner or upload only images you are licensed to use. See IPO guidance on using images and copyright.

F. Children & parental consent

Under-13s: If any person in the image is under 13 years old, the uploader must be the parent or legal guardian and must complete the Parental Consent section below. For online services using consent as legal basis, parental authorisation is required for under-13s (UK GDPR / ICO guidance). We will take reasonable steps to verify parental responsibility where necessary.
Aged 13–17: For persons aged 13–17, ensure you have the minor’s consent as appropriate; additional safeguards apply and we will handle such images with enhanced privacy protections.

G. Sensitive information & special categories

Do not include special category data (e.g., health details, racial or ethnic origin, sexual orientation) unless strictly necessary and you provide explicit consent. If you voluntarily supply special category information in story text, you confirm you have lawful grounds (explicit consent) for Muruga Ltd to process it. Muruga Ltd will minimise processing and only use such content to the extent strictly necessary.

H. Withdrawal, erasure & limitations

You may withdraw marketing consent at any time (see Section D).
You may request erasure of uploaded images after the 14-day retention period (or earlier in limited circumstances) subject to the company’s obligation to retain records for legal/tax reasons or to preserve evidence of a dispute. If an order is still being produced, you cannot withdraw the licence insofar as necessary to complete that order. See our Privacy Policy and Data Retention Schedule for more.

I. Electronic acceptance

By uploading images and checking the boxes on the upload/checkout page you acknowledge that:

You have read and understood this Image / Model Release & Consent Form; and
Your electronic agreement is intended to have the same legal effect as a handwritten signature; and
Muruga Ltd will store a timestamped record of this consent and the uploaded files for audit and compliance purposes.
